The claimant, a 58-year-old man, received £160,000 after being diagnosed with mesothelioma in August 2006. He had previously worked in glass factories where he had been exposed to asbestos. His life expectancy from the date of diagnosis was between 18 months and 2 years.

Claimant: Male: 57 years old at date of knowledge; 58 years old at date of settlement.

Employers' Liability; Industrial; Occupational Disease: During the 1960s and early 1970s, the claimant (C) was employed by the defendants (D) to manufacture glass in their factories. During his employment he was exposed to asbestos at various times. On August 24, 2006, C was diagnosed with right-sided epitheliod mesothelioma.

C sustained injury and brought an action against D alleging that their negligence caused the mesothelioma.

Judgment was entered for C.

Injuries: C suffered from epitheliod mesothelioma.

Effects: C retired from his job as a maintenance engineer approximately three months after being diagnosed.

C's life expectancy was estimated to be between 18 months to 2 years from the date of diagnosis. He was expected to experience a decreasing quality of life and increasing pain and disability, requiring an increasing amount of care and assistance.

Out of Court Settlement (approved): £160,000 total damages.

Background to damages: The case was settled on a global basis with no particular breakdown of damages. However, the following breakdown was estimated by the claimant's solicitors:

Breakdown of General Damages: Pain, suffering and loss of amenity: £65,000.

Special Damages: £95,000.
