The claimant, a 73-year-old man, was awarded £22,900 for the bilateral pleural plaques and bilateral pleural thickening he suffered following exposure to asbestos at work between 1975 and 1997.

Claimant: Male: 70 years old at date of knowledge; 73 years old at date of award.

Employers' Liability, Industrial, Occupational Disease: Between 1975 and 1997, the claimant (F) was employed by the defendant (D) as a plant engineer, chargehand and resident engineer. F was exposed to asbestos during the course of his employment with the defendant when carrying out repair and maintenance work in premises owned by D.

F sustained injury and brought an action against D alleging negligence on the grounds that their acts or omissions or both caused or allowed F to be exposed to asbestos dust during his employment.

Liability admitted.

Injuries: F developed bilateral pleural plaques and bilateral pleural thickening as a result of his exposure to asbestos dust.

Effects: F began suffering with symptoms of breathlessness in approximately 2000. Investigations showed the presence of pleural thickening and F was informed of the diagnosis in November 2002. F's respiratory disability was estimated at 30 per cent, of which 10 per cent was due to asbestos induced pleural disease and the remaining 20 per cent to an unrelated cardiac condition.

There was a 10 per cent risk that F's pleural thickening would progress to a degree sufficient to cause a material increase in disability. There was a three per cent risk of F developing malignant mesothelioma. F's risk of developing lung cancer was doubled by his exposure to asbestos.

Court Award: £22,900 total damages.

Breakdown of General Damages: Pain, suffering and loss of amenity: £20,500; Future losses: £2,400.
