DAMAGES - EMPLOYMENT - PERSONAL INJURY
ASBESTOSIS : DAMAGES : EMPLOYMENT : LOSS : MORE THAN MINIMAL DAMAGE : ACTIONABLE DAMAGES
On the evidence the claimant was suffering from asbestosis which was more than minimal and was actionable damage for the purpose of the recovery of damages in a personal injury claim.
The claimant former employee (H) claimed damages for personal injury from the defendant employers (P).
H had been employed by P as a roofer for approximately 35 years. P accepted that during the course of his employment H had been wrongly exposed to significant levels of asbestos.
H issued proceedings and sought damages for personal injury and loss caused by P's negligence and for breach of statutory duty. H contended that the personal injuries caused were asbestosis and diffuse pleural thickening. Liability was conceded at trial but causation and quantum remained in dispute.
HELD: On the evidence H was not suffering from diffuse pleural thickening but was suffering from asbestosis. The asbestosis had already caused H to suffer material physical damage, namely a one per cent disability, together with a significant loss of reserve lung capacity.
Whilst the effect of that damage was not at present substantial it was certainly more than minimal and was actionable damage for the purpose of the recovery of damages.
