The claimant, a 78-year-old woman, received £115,000 after contracting malignant mesothelioma from exposure to asbestos. She had worked in a factory for the defendant for two years during the early 1970s where she had been exposed to asbestos fibres. She required ongoing nursing care and was not expected to survive for more than six months.
Claimant: Female: Between 41 and 43 years old at date of accident; 78 years old at date of settlement.
Employers' Liability; Industrial; Occupational Disease: During the early 1970s, the claimant (C) worked for the defendant company (D) at their toy factory for two years.
Approximately 33 years after working at the factory, C was diagnosed as suffering from asbestos-related malignant mesothelioma.
Liability admitted. D disputed causation and denied that C was suffering from mesothelioma. D argued that C was suffering from a secondary tumour as she had previously suffered breast cancer.
Injuries: C suffered from mesothelioma as a result of exposure to asbestos fibres from the lagging on pipes at the factory.
Effects: C suffered from shortness of breath, pain and limited mobility and required nursing care.
Prognosis: C was not expected to survive for more than six months.
Out of Court Settlement: £115,000 total damages (by consent order)
Background to damages: The claim settled following the joint memorandum of the parties' respective consultant histopathologists who agreed that C was suffering from mesothelioma. The case was settled on a global basis with no particular breakdown of damages. However, the following breakdown was estimated by C's solicitors:
Breakdown of General Damages: Pain, suffering and loss of amenity: £67,500; Future nursing care costs: £15,000; Funeral expenses: £3,500; Future loss of dependency: £28,640.
Breakdown of Special Damages: Past miscellaneous expenses: £360.
