A mesothelioma victim has secured an out of Court settlement which incorporates the cost of private chemotherapy and nursing care.
The claim brought by Amarjeet Singh Dahele was brought against Thomas Bates and Son, a construction firm.
The total award of £400,000 included £20,000 for the cost of the private chemotherapy and nursing care.
The settlement was agreed just one hour before the case was due in Court but it sets a precedent that may help other victims of meosthelioma.
Many victims of the incurable cancer are currently awaiting the final decision of the National Institute for Clinical Excellence in relation to Alimta treatment.
Inclusion of private costs of chemotherapy in damages awards might enable some of those victims to gain access to treatment that is currently difficult to obtain on the NHS.
