The publication of a bill last week in the Scottish Parliament helped Scottish sufferers from mesothelioma move a step towards justice.
The Bill, proposed by Des McNulty, Labour MSP for Clydebank, closes a legal loophole which meant compensation could be paid to a living sufferer but at a lower rate than would be paid to the surviving family after death.
The legal anomaly has left victims facing the dilemma choosing between maximising their family’s benefit but at a personal cost in the final months of their lives.
The Bill only relates to sufferers from mesothelioma. Asbestos campaigners had hoped the law change could go wider and would benefit those suffering from other work related fatal illnesses.
It was, however, limited to the one condition in order to allow it to go through Parliament before dissolution for next year’s election.
Mr McNulty said “I am delighted the Executive has introduced the Bill.
Victims will now be able to pursue those responsible for compensation without fear that the rights of their families to compensation for their loss being extinguished”.
