Asbestosis- the case facts

We were approached by Mr P in 2018. At that time, he had been diagnosed with asbestos pleural plaques.

Asbestos victims cannot claim compensation for that condition, so we placed him in our PLEURAL PLAQUE register. We are one of very few such registers in the country.

We kept him under review and got in touch in 2022 and 2025.

On that later letter Mr P got in touch. He had been feeling worse and noticed his health had got worse. He had been given oxygen to use and wondered if his problem was due to asbestos.

Asbestosis- getting things right

Our team know that often asbestos victims are not informed of their condition or do not understand medical jargon.

We got Mr P’s medical records and scrutinized them very carefully. We found that the possibility of asbestosis had been mentioned as early as 2017. There then seemed to be a belief that Mr P knew about his condition. He never did.

Mr P had been very active for his age but noticed that he was less able to enjoy ball room dancing and bowls and in the everyday care and attention to his house.

We built a plan to try and get the case firmed up and deal with the knowledge issue.

Asbestosis-the three year rule

There is a strict three year rule which applies to personal injury claims. An accident victim suffering an injury had three years from the date of that accident to issue court proceedings.

This is called limitation.

The same applies to work related disease claims. Many cases for work related deafness or chest disease have failed due to victims not acting quickly enough when told or believing they may have a work related condition.

Our plan and the outcome

Our team understand that what is noted in records and what patients understand can be two different things. We took the time to go through each medical appointment and do a detailed many page statement confirming no knowledge of this condition. Time was spent with the medical expert to deal with this.

We then obtained a medical report from an expert in asbestos disease.

His report confirmed Mr P had asbestosis and this was causing 50% disability. HIs last years would be blighted by this condition.

Armed with this we went to the defendants.

The road to settlement

Our team is very experience din asbestosis claims and are used to picking up cases which are difficult.. https://www.corries.co.uk/asbestosis-claims-york/

Faced with well drafted statements about asbestos exposure, the limitation statement and medical evidence the defendants soon admitted the claim.

Consequently negotiations quickly followed and a substantial five figure settlement was agreed. At 91 years of age Mr P is keen to enjoy the rest of his life and to make sure his remaining life can be as comfortable as possible.

Asbestosis comment

Corries Solicitor/director Howard Bonnett, who won the claim commented

“Undoubtedly asbestos claims are proving harder to fight and to win than in my whole 35 years in the law. Insurers and their solicitors are drawing out cases ever longer than ever to deprive asbestos victims of compensation.

Importantly, well thought out and detailed preparation of cases is needed in cases, in particular  for elder victims.

My firm is committed to help all asbestos victims. Even if they are older, they are still entitled to the same level of care and attention we give every client. That is our promise to every client”
