Adult Injuries

Adult injuries are on the increase. Over the past thirty or so years the use of erotic accessories has become more popular. As a nation we may have become more liberated but where do we turn to when things go wrong?

The adult toy, sexual aid and lubricant industry is a growing market in the U.K. Some estimates place the value in the region of £250 million with an estimated 400 million erotic accessories sold annually 1, by 2020 sales are anticipated to match those of smart phones.

One major retailer alone has an annual turnover of £140 million 2.

Legal principles

In law, any injury must have occurred within the last three years from a product supplied not more than ten years ago. Any injury occurring more than three years ago is out of time and barred in English law 3.

Whenever a product is made, it must be safe for its intended use. If a product causes an injury , the person injured has the legal right to make a compensation claim against the manufacturer or the person who sold them the product.

All manufactured goods have the potential to be faulty and cause injuries. With any industry of this size, there are good products and bad products. Poorly manufactured or designed products are more prone to causing injuries to users. Manufacturers have a legal responsibility to ensure that their products are designed and made to an acceptable level of safety 4.

The adult sexual aid industry is no exception to this legal requirement.

Potential injuries

The number and variety of potential injuries due to defective sex toys, aids and lubricants is almost as varied as the number of products on the market. Some common possibilities can include:

  • internal tearing
  • cuts / abrasions
  • severe bleeding
  • requirement for non-surgical or surgical removal of a foreign object
  • electrocution
  • dermatological reactions to chemicals
  • fertility issues
  • perforated internal organs such as the bowel

Adult Injuries – Case Studies

As a firm of solicitors, we have made a number of claims stemming from injuries caused by the proper use of erotic accessories that were faulty. Here are some examples:

  • One couple used a pleasure enhancing cream, which caused severe genital burns. It also caused an intense itching in the genital region of one partner. The gentleman in this case required an exploratory procedure of his urethra and a general anaesthetic. We successfully recovered damages for this couple’s pain and suffering both physically and emotionally.
  • Another client purchased a vibrator which contained metal beads within the sealed silicone vibrating unit. Upon first insertion of this vibrator, our client was injured due to a tear in the silicone which allowed the metal beads to come into direct contact with her and caused internal injuries. Our client suffered severe pain, bleeding and potential bladder injuries. This lady required a cystoscopy. We successfully recovered compensation for this lady’s pain, suffering and loss of amenity.

Evidence

As with any claim for a defective product causing injury, it is important that the item is used in accordance with the manufacturer guidelines and for the purpose for which it was intended. Evidence that medical attention was sought in relation to the injuries is required. In some cases photographic evidence of the injury or resulting damage is vital.
